Subject: The Anti-Money Laundering Authority Compliance Unit's Inaugural Regional Conference

Members of our Team, Nicola Berry and Ashley Mayers, recently attended the Anti-Money Laundering Authority Compliance Unit’s inaugural Regional Conference on October 17 and 18, 2024. The theme for the conference was “Protecting the Vision of a Fully Compliant AML Network in the Caribbean: Designated Non-Financial Business or Profession (DNFBP) Edition”. It focused on the DNFBP sector and brought local, regional and international industry specialists and regulators together for enlightening discussions on current issues.

The sessions raised key industry concerns and identified potential solutions surrounding Know Your Client (KYC) Risk Assessments, The Development of AI in KYC, The FATF AML/CFT/CPF 5th Round of Mutual Evaluation, Cyber Security, Due Diligence Capabilities and Suspicious Transaction Reporting within the region.

Highlights include:
1. It is crucial for DNFBPs to know their clients by undertaking the necessary KYC checks; it is also important for them to know their employees;
2. There are tensions between data privacy requirements and AML disclosure requirements; compliance is still possible;
3. Suspicious Transaction Reports must be filed with the relevant authority in the shortest time possible from the time the suspicion arose and in any event within the required time period; it can also be filed in circumstances where a person was not onboarded as a client;
4. AI tools can assist with more efficient KYC processes; and
5. It is necessary to operate from a risk-based approach rather than only a rules-based approach when designing and implementing AML compliance programmes.
We look forward to participating in future regional conferences held by the Compliance Unit.

Our team recently joined the Barbados Chamber of Commerce and Industry (BCCI) on National Sneaker Day to promote its “Get Active Initiative”, held on September 27, 2024.” This event is part of the BCCI’s support of the national effort to increase awareness of the growing challenge of non-communicable diseases (NCDs) and to promote healthier lifestyles within our community. We congratulate the BCCI’s Secretariat on spearheading this initiative.

Subject: Regional Workshop for Caribbean SIDS on the BBNJ Agreement

Our Professor Berry, Professor of International & Regional Integration Law at UWI, Cave Hill Campus, recently participated as a presenter at The UN Division for Ocean Affairs and the Law of the Sea regional workshop for Caribbean small island developing states hosted by the Government of Belize from 7 to 10 October 2024 at the Umaya Resort in Placencia, Belize. The Division for Ocean Affairs and the Law of the Sea of the Office of Legal Affairs of the United Nations arranged this workshop to promote a better understanding of the Agreement under the United Nations Convention on the Law of the Sea on the Conservation and Sustainable Use of Marine Biological Diversity of Areas beyond National Jurisdiction (BBNJ Agreement).

Members of our team, Ms. Megan Harris, Executive Assistant/Paralegal and Ms. Ashley Mayers, Attorney-at-Law attended the Barbados Chamber of Commerce and Industry’s New Members Onboarding Mingle 2023 – 2024 on the cusp of the Chambers’ 200 year anniversary, held on April 26th, 2024. This mingle was both an informative and exciting session held by the BCCI’S secretariat.

Subject: Employment Law

Although the Covid-19 pandemic is behind us, in January 2024, the Barbados Employment Rights Tribunal (“ERT”) determined an issue arising out of the pandemic relating to whether an employer could require an employee to take covid-19 tests or get vaccinated to report to work.

The ERT considered whether (i) the respondent’s Covid-19 guidelines were discriminatory and in breach of the Employment (Prevention of Discrimination) Act, 2020-26 (the “Act”) and; (ii) if so, whether the claimant suffered any consequential disadvantage, detriment or restriction. The ERT ruled that the respondent’s policy requiring the employee to present a Covid-19 vaccination certificate or a weekly negative Covid-19 PCR test result to work was discriminatory and in contravention of the Act. The tribunal also determined that the claimant had not sought compensation or any other remedy however had she done so it is likely that she would not have prevailed since any disadvantage or restriction or detriment which the claimant suffered was remedied by the date of the hearing.

Subject: Recent Development

The Fair Trading Commission has issued a consultation paper on Feed-in-Tariffs (FIT) for Renewable Energy Systems Sized 1MW and up to 10MW by way of notice dated October 16, 2023. On December 31, 2022 the Commission issued its FIT Decision for renewable energy systems 1MW and up to 10MW which expires on December 31, 2023. The Commission is now seeking public input into the review of its FIT decision. The deadline for submission of comments is Monday, November 13, 2023. Please see details at:

Subject: Public International Law

On March 4, 2023, a historic agreement was concluded by 193 countries at the United Nations Headquarters in New York to protect and safeguard the world’s marine biodiversity of areas beyond national jurisdiction. Our consultant, Professor David Berry, served as Barbados’ Alternative Representative to the Inter-governmental Conference to conclude the Agreement and, in addition to providing international legal advice to the CARICOM team, served as the CARICOM Lead for Part III of the Agreement, on Area Based Management Tools.

The Barbados Financial Services Commission has issued a consultation paper entitled “Corporate Governance Guideline” applicable to financial institutions registered and or licensed with the Financial Services Commission. The proposed Guideline comprises policies and practices that financial institutions are expected to adopt and implement to demonstrate effective corporate governance. Nicola Berry conducted a Virtual Skills Training Workshop put on by the Chartered Institute of Arbitrators Caribbean Branch Young Members Group (“YMG”) on June 22 and 24, 2022. The focus of the ADR Clinic was “Drafting Arbitration Clauses”. The topics examined in the Workshop included validity, essential provisions of the arbitration clause and multi-party contracts.
